Royal Decree 933/2021: Everything you need to know about the Registration and Communication of guest data.



For a couple of years now, the Ministry of Interior has been negotiating the introduction of regulations to protect citizens from organised crime and terrorism.


As a result the Ministry has introduced the Royal Decree 933/2021, which establishes the obligation of documentary registration and information of natural or legal persons who provide accommodation and motor vehicle rental activities.

Who is affected by the regulations? 


The regulation affects businesses catering to accommodation activities, motor vehicle rental, tour operators, digital platforms, and non-professional individuals.


On December 2  2024, the adaptation period finalises for those affected by the norm.


Where to submit the information 


The Ministry of the Interior has enabled the SES.HOSPEDAJE platform for the communication of guest data.


What information do you need to provide as an owner of a holiday house? 


Accommodation providers are required to collect a list of traveller data with each booking:


  • Name.

  • First surname.

  • Second surname.

  • Sex.

  • ID number.

  • ID support number.

  • Type of document (DNI, passport, TIE).

  • Nationality.

  • Birthdate.

  • Place of residence.

– Full address.

– Locality.

– Country.

  • Telephone.

  • Mobile phone.

  • Email.

  • The number of travellers.

  • Kinship relationship between travellers


What if the booking is made by an intermediary? 


  1. The intermediary must submit the information for each booking through its booking portal. 

  2. The accommodation must present the information at the beginning of the service contract.



Growing Concern in the Tourism Sector 


If your occupation is related to tourist accommodation, you may already know about the controversy the regulations have generated in the sector. Both national and European associations have expressed frustration at the exorbitant amount of information that needs to be collected, the high costs of its implementation, and the mistrust it can generate in travellers.


They highlight how tourists will be reluctant to choose Spanish destinations due to the excess of information they must provide during the booking. 


A major blow to Homeowners and Micro-Businesses 


Both owners and micro-businesses are heavily affected by the regulation as they will facing a disproportionate administrative burden and high additional costs.


Any error in the processing and communication of the data will result in penalties ranging from 100 to 30,000 euros.
