The website holidaytravelchannel.com (hereinafter, the “Website”) is operated by HOLIDAY TRAVEL CHANNEL SPAIN, S.L. (hereinafter, “HTC”), whose registered office is at Calle Conquistador 7, 1st floor, 07001 Palma de Mallorca, Spain. The company’s identification details and contact information are also available in the Website’s Legal Notice.
These terms and conditions govern the use of the Website, direct enquiries and bookings for tourist accommodation, and the information and customer support services associated with stays. The specific accommodation conditions, selected rate and booking confirmation form part of the contractual relationship.
HTC markets and manages tourist accommodation either on its own behalf or on behalf of third parties, depending on the accommodation and the relevant agreement. Where HTC acts as an intermediary or property manager on behalf of the owner, this capacity and the identity of the accommodation provider will be disclosed in the booking documentation. Nothing in these terms shall restrict any mandatory consumer rights.
Users agree to provide accurate information, use the Website lawfully and respect the rights of third parties. They must not access restricted areas without authorisation or interfere with the Website’s operation.
Accommodation listings display the relevant features, maximum occupancy, approximate location or address where applicable, facilities, availability, prices, house rules and specific conditions. Photographs are provided for information purposes; however, the essential features of the accommodation as booked will be respected. Any obvious material errors will be notified and resolved before the booking is confirmed, without any subsequent abusive unilateral changes.
Guests select their accommodation, dates, number of occupants and rate, check the total amount and applicable conditions, provide the necessary details and choose an available payment method. Before making a booking that entails an obligation to pay, guests are provided with a summary and must expressly accept these terms and conditions.
The booking shall be deemed confirmed once the relevant confirmation has been issued, in accordance with the process displayed on the Website. Guests will receive electronic confirmation containing the booking reference, the essential details of their stay and the accepted conditions, which they may save or reproduce. A mere enquiry does not constitute a confirmed booking.
The person making the booking declares that they are authorised to act on behalf of the other guests and agrees to communicate the accommodation rules to them. Occupancy must not exceed the authorised capacity and must not include undeclared persons where registration is required.
Prices are displayed in euros and include the items specified during the booking process. Before the booking is confirmed, guests will be informed of the total amount payable, including all known mandatory taxes and charges. Where an item depends on actual consumption, the calculation method and settlement procedure will be specified.
The legally applicable tourist tax, cleaning fees, separately charged utilities, optional services and security deposits or guarantees will be itemised where applicable. Additional charges will not be applied without prior information and, where required, express acceptance.
Any special conditions concerning electricity, heating, maximum consumption limits or additional services at certain villas and country properties will only be enforceable if they have been communicated before the booking is made.
For direct bookings made through the Website, guests may choose from the available payment methods: card payment through a secure payment gateway connected to Redsys or Stripe, or bank transfer. The specific payment methods available will be displayed during the booking process, and guests may choose from those offered.
As a general rule, the initial payment will amount to 30% of the booking price, with the remaining 70% due 30 days before arrival, unless the rate details or booking confirmation specify a different schedule. Bookings made within 30 days of arrival will normally require full payment. The amounts, due dates and consequences of non-payment will be displayed before the booking is confirmed.
If bank transfer is selected, the necessary bank details and payment identification instructions will be provided through official channels. The booking will be subject to the expressly communicated rules governing confirmation of receipt of payment. Payments must not be made to bank accounts or through links communicated by unverified third parties.
Technical card payment processing is handled by the authorised payment service provider. HTC will never request full card details, PINs or authentication codes by email or messaging services. Direct refunds will be processed through the relevant payment channel and in accordance with applicable regulations.
For the standard rate applicable to direct bookings, HTC applies the following cancellation penalty schedule to the price of the booked accommodation, based on the cancellation scheme and refund provisions set out in Holidu’s technical documentation:
Time before arrival | Cancellation penalty | Refund of accommodation price |
61 days or more | 0% | 100% |
Between 60 and 31 days | 50% | 50% |
Between 30 and 8 days | 80% | 20% |
7 days or fewer; no-show | 100% | 0% |
The number of days shall be calculated with reference to the arrival date and time stated in the booking confirmation and according to the local time zone of the accommodation. The cancellation penalty applies to the amount subject to cancellation as disclosed at the time of booking. Taxes or services not incurred shall be treated in accordance with the applicable law. If the payments already made are lower than the applicable cancellation penalty, the difference may be claimed in accordance with the agreed terms and current legislation.
The non-refundable rate shall only apply where the guest selects it and its specific conditions are expressly displayed before payment. Where different specific cancellation policies apply, the policy expressly displayed and accepted for that rate shall prevail. HTC will not retrospectively change the conditions accepted by the guest. Cancellations must be requested through the contact channels specified in the booking confirmation and shall take effect upon receipt, provided that such receipt can be evidenced.
Where guests book through Airbnb, Booking.com, Holidu, Vrbo, Expedia or any other third-party platform, the booking, payment, cancellation and refund conditions displayed and accepted on that platform shall apply, together with the legitimate accommodation rules.
Payments, refunds, the retention or release of funds, and deposits or guarantees managed by the platform or OTA shall be handled through its own systems and procedures, where provided for by the platform. HTC does not replace the operator responsible for these processes and cannot guarantee their processing times. For enquiries concerning transactions managed by an OTA, guests must use the platform’s official channels, without prejudice to any legal rights they may exercise against the relevant responsible party.
Where accommodation requires a security deposit or guarantee, the amount, method, timeframe and applicable conditions will be communicated before the booking is made. The security deposit does not constitute an advance payment towards the rental price.
For bookings made through OTAs offering their own deposit, payment retention, damage cover or refund mechanism, the establishment, processing and release of the deposit shall be governed by that mechanism. For direct bookings, or where the platform does not provide such a system and an expressly disclosed and accepted guarantee applies, the procedure specified in the booking confirmation shall be followed.
Any deductions for damage must be justified and relate to damage attributable to the guest, excluding normal wear and tear. The guest will be informed of the incident and provided with supporting details, and the remaining balance will be refunded within the stated timeframe and in accordance with applicable law. This clause does not authorise duplicate charges for the same damage.
Requests to change dates, occupancy or services are subject to availability and the conditions of the selected rate or OTA used. Any price difference or administration fee will be communicated before the change is accepted.
If, for a reason attributable to the accommodation provider, the booked accommodation cannot be made available, the guest will be informed without delay and, where feasible and accepted by the guest, an equivalent or superior alternative will be offered at no additional cost. Otherwise, the relevant amounts will be refunded, without prejudice to any other rights recognised by law. The accommodation will not be unilaterally replaced with another property of inferior standard or features.
As a general rule, check-in is from 3.00 pm and check-out is before 10.00 am, unless otherwise specified in the accommodation listing or booking confirmation. Arrivals outside standard hours, key handovers, access via key safes or keypads, and additional services will be subject to the specific instructions for the accommodation.
Guests must provide reasonably necessary arrival information to facilitate check-in arrangements. Access will be provided through HTC’s official channels or those of its authorised representative. Access instructions may be conditional upon compliance with the legal identification and guest registration requirements.
As required by law, the documentary and contractual information necessary for guest registration and reporting to the competent authorities will be requested in accordance with Royal Decree 933/2021 and any other applicable legislation. Electronic registration and signature procedures may be used. Travellers must provide the required valid identification documents and cooperate in the verification of their identity.
Personal data will be processed exclusively in accordance with the applicable legal basis, data retention obligations and Privacy Policy. Minors will be subject to the applicable legal registration requirements.
The accommodation must be used exclusively for tourist stays during the booked period. Over-occupancy, unauthorised parties or events, unlawful activities, serious disturbance to neighbours and breaches of safety or community rules are prohibited. Smoking indoors is prohibited where expressly stated; pets are only permitted where this is allowed in the accommodation listing or booking confirmation.
Guests must take proper care of the property, furniture and equipment, report any damage without delay, respect quiet hours and follow waste disposal instructions. Access by authorised personnel for repairs, maintenance or inspections will be arranged with reasonable prior notice, except in emergencies requiring immediate intervention.
Serious breaches may result in the relevant contractual and legal measures, including termination where appropriate. Guests will never be deprived of mandatory legal rights, nor will penalties that have not been previously disclosed be imposed.
Any problems arising during the stay should be reported as soon as possible through the official contact channels specified in the booking confirmation or accommodation information, so that they can be investigated and resolved. HTC will endeavour to provide assistance and coordinate the actions for which it is responsible.
The absence of an immediate or written complaint does not, in itself, automatically result in the loss of statutory rights. Complaints will be handled in good faith and in accordance with consumer protection legislation. Users may also refer matters to the competent administrative or judicial authorities.
HTC shall be liable for its own breaches and for the obligations it has contractually undertaken, in accordance with applicable legislation. Where appropriate, the actual accommodation provider shall be responsible for the obligations falling within its remit. No clause shall exclude liability for wilful misconduct, gross negligence, personal injury or any other circumstances in which such exclusion is prohibited.
Unforeseeable or unavoidable circumstances beyond the reasonable control of the parties shall be assessed in accordance with applicable legislation and the relevant terms and conditions. Such circumstances do not automatically result in the loss of all refund rights or permit the restriction of non-waivable statutory rights.
HTC may provide a digital guest area containing accommodation instructions, documentation, local information and service-related communications. Guests must keep their login credentials secure and must not share personal access links.
The virtual assistant Alba provides general information and practical guidance. Its responses do not replace contractual confirmation, human customer support or emergency services. Essential booking details, amounts and payments must be checked against official documentation. Guests may request assistance from a member of staff. In an emergency, guests must call 112.
The availability of digital features may vary depending on the accommodation. Contracted services and guests’ rights are not conditional upon using an artificial intelligence assistant.
Communications relating to a booking may be sent by email, SMS, WhatsApp or other channels provided by the guest, insofar as necessary to provide the service and in accordance with applicable legislation. Acceptance of these terms and conditions does not constitute consent to receive electronic marketing communications.
HTC will never request banking passwords, card verification codes or sensitive financial information through messaging services. If an unexpected payment request is received, guests must verify it directly using the contact details published on the Website or provided in their booking confirmation.
The processing of personal data is governed by the Privacy Policy, which is accessible through the Website and identifies the data controllers, purposes of processing, legal bases, recipients, retention periods and individuals’ rights. The use of non-essential cookies is subject to the information and preferences collected through the relevant consent mechanism.
Data required to comply with guest registration obligations will be processed under its own applicable legal basis. Marketing communications, where consent is required, will be subject to a separate and voluntary consent process.
The contents of the Website, including texts, photographs, trademarks and designs, are protected by applicable legislation. Personal viewing is permitted, but commercial exploitation or unauthorised reproduction is not. Links to external websites may be subject to their own terms and policies.
These terms and conditions shall be interpreted in accordance with Spanish law and any mandatory consumer protection provisions that may apply. The possible invalidity of any individual clause shall not affect the remaining provisions.
Disputes involving consumers shall fall under the jurisdiction of the courts and tribunals determined by law. No territorial jurisdiction clause shall be imposed that deprives users of their legal rights. Public consumer complaint and redress mechanisms remain available.
The version applicable to each booking shall be the version accepted at the time of booking, without prejudice to any subsequent changes required by law or accepted by the parties. HTC may update these terms and conditions for future bookings and will publish the current version together with its revision date.
Guests may save or print these terms and conditions and their booking confirmation. Enquiries should be directed to the official contact details published on the Website.
